Apple fails in bid to get Samsung Galaxy S3 banned

Samsung has been left celebrating after Apple failed in its bid to get sales of the Galaxy S3 banned in the US.

Apple had claimed that the Korean firm had infringed on its interface patents to design the latest flagship mobile phone that is expected to be hugely popular on its release later this month.

Samsung countered this by suing the Australian patent office earlier this month because some documents granted between 2009 and 2010 were beyond the power of the patents commissioner.

The American giant had hoped to add the sales ban to existing complaints against Samsung but US District Court Judge Lucy Koh has quashed this hope.

She said in her ruling that the current pending motion for preliminary injunction is fully briefed and therefore cannot be added to with any further discovery.

"If Apple seeks to file a motion to enjoin sales of the Samsung Galaxy S3, Apple will have to request a new hearing date from the court," the judge added.
