Optus to appeal to High Court in mobile phone highlights row

Optus has confirmed it will take its fight over showing sports highlights on mobile phones to the High Court.

It will appeal a Federal Court ruling that effectively ended the firm's TV Now service for mobile phone customers that allows them to watch recorded programs on their devices.

Optus has been embroiled in litigation with Telstra, the NRL and AFL since February over whether its customers can view near-to-live action from the sports despite not being the rights holder.

Last month, another Federal Court ruled in favour of Telstra and the two sports, forcing Optus to go back to the drawing board.

Chief executive of the firm Paul O'Sullivan said the TV Now case is hugely important in terms of innovation and consumer choice in the market.

"This is a very important public policy issue that needs to be determined by the highest court in the land, to give clarity to both consumers and the industry," he added.
